By "someone who lives out of state" I assume you are talking about an individual, correct?
If that is the case, then the deal must go through an FFL in GA. The "someone" in question can bring the gun to the GA FFL and you can conduct the deal in person at that FFL's place of business, but you will have to fill out a 4473.

Yes. Individual seller.
You will probably have to pay a small fee (usually around $25) to the FFL to do the transfer.
It's the seller breaking the law in this case I'm 99.9% sure. They're the one doing the interstate commerce without proper licensing.
