When the private prison industry takes over a prison the govt signs a contract guaranteeing 95% occupancy. So, if there are not enough legitimate criminals the government has to pass laws to make more. That and the industry lobbies the hell out of congress. There are certain things that should never become private of profit driven. Private prisons actually do not even save money, and in many was are worse then govt run prisons.
