Class III Trust...

OK, wait. So the benefit of the trust is you do not have to have the wait time, you just pay the $200 after you add each
NFA item to the Trust?


No the benefit(s) of the trust are 1.) No CLEO sign off you don't have to drive down to Sheriff's office and get him to sign the Form 4, 1, etc. 2.) No passport photos 3.) No fingerprints. All of these are REQUIRED if you purchase NFA items as an individual.

The trust you created will be the owner of the NFA items, anyone listed on the trust has access to them. Meaning if your wife is listed on the trust she can take the NFA goodies to the range without you having to be there with her. If you go the CLEO route, you MUST be present with the NFA items at all times, so if your wife wants to use them YOU MUST BE WITH HER.
 
I would rather pay someone up to $100 to do it. The way King had it set up, You sent him a check for $100 and all your info as far as the trust goes and he did it for you. Even then though, what is the process for attaining the stamp. It is all such a headache....:mad:


Funny, Kings trusts had an "omission" of a document that the ATF previously never needed for approval , now they do and were sent back for correction, technically some of Doug's trusts are invalid according to the BATFE. To date there has not been a single Quicken Willmaker denied by the ATF. This is coming from at one time the largest or second largest Silencer dealer in the country, who still sells NFA items at his new gig in Winder.

If you have mailed out for a stamp in Jan or more recent be prepared for a letter stating your trust may be invalid. You are missing an attachment listed

in Section 9 called "Schedule of compensation for trustees".

If you used most popular software to create your Trust, you won't have this problem.

If you went to a local lawyer who was pretty well regarded for making NFA=specific Trusts, chances are you are missing this form.

Before you panic read your Trust (as you should anyway) and see what "Schedules" are mentioned in the document. The ATF will want to see all schedules mentioned in the document.

We've recently had several Trust transfers rejected for the issue described by the OP. All were created by a lawyer. We've had zero problems with any transfers to Trusts created by software like Willmaker. Just FYI.

It's just as easy as going to a dealer and buying a gun /filling out a 4473. All it takes is a $10 software program, 10 minutes of your time to fill out the fields it asks you to fill out, a printer, a notary to sign the trust (your bank has one) an envelope, and a check for $200. Pretty much all Class III dealers will fill out the Form 4 for you, stick both copies, a copy of your trust, and a check for $200 in an envelope and wait 6 months. In fact I just filled sent out a Form 4 today for another SBR AR lower.
 
So how much you wanna charge?

Step 1. Drive to Bullseye in Lawreceville
Step 2. Buy silencer
Step 3. Bullseye creates your trust and fills out your Form 4 all you do is get it notarized, put check and everything else in envelope and mail it.

Or
Step 1. Buy quicken for $10 of Amazon or Ebay

One bit of advice. If a lawyer does your trust you are covered by his malpractice insurance if something goes wrong. Form programs, fill in the blank forms, and posted forms done for others will not help you if your trust is found to be invalid and you now illegally own a class 3 item.
With that said, most mistakes are never found, but you don't want to be the one they do find.
FYI. Georgia Trust laws have changed, and since NFA Trusts are constructed state by state because the trust itself is based on state law, and everyone's situation or trust structure and needs are different, I do caution against carelessly making a trust.
