Maybe have 2 different red banners. One for Item Gone when the seller marks it as sold and one that says Expired when the listing expired. Should prevent people from messaging the Item Gone listings and let's them know they may have a chance of it being available if it's just expired.

I also understand the annoyance of the placement of the banner. If you are trying to copy and paste something behind the banner it won't allow you to highlight it. I do this sometimes when creating a new listing where I need to make changes to the listing so I create a new one instead of reviving the old one and I copy and paste some things from the old one.
