Part of the TDI emissions scandal was that the cars could be set to run in one of two modes: "road/driving" or "Dyno/test" modes. It's the dyno/test mode that got VW into trouble because this mode had a different tune that cheated the emissions test. It sounds like either the car doesn't have the required updated "recall" tune or the emissions testing equipment isn't updated to deal with the recall tune.
