The U.S. Supreme Court has repeatedly upheld federal regulation of intrastate commerce up to, and including, calling the 10th Amendment nothing but a "truism" and not a limitation of Congressional power (decision here http://caselaw.lp.findlaw.com/cgi-bin/getcase.pl?court=us&vol=312&invol=100).

The federal power to regulate intrastate transactions is not limited to persons who are engaged also in interstate transactions.

Based on case law and history, the court would likely uphold any such regulation of Intrastate commerce based on the potential it has to affect interstate commerce. The best bet to defeat such legislation is to ensure it never passes, not to rely on the courts to over-turn it.

It's not currently taxed as income... I work for a small company and that was one of the ways the company 'compensated' us- although the boss warned us that next year it will likely be taxed as income. For those of us with family coverage, that's going to be another one to two thousand bucks income tax.
 
Guys, you're not getting what is happening. The Constitution is history. It has already been violated in so many ways you can't even keep count any more. It has just gotten to the point that they are going to drop any real premise of Constitutionality in their acts.
