It's unclear exactly what the wife initiated or agreed to. I realize it's implied she was mislead.

It depends on whether it was a "community property state" or not. If it is then they are her guns, at least legally speaking.

I'm not a lawyer but if everything in a home becomes community property JUST because it's in the home, well, that would present ALL KINDS of interesting legal issues. "Well officer, those drugs are hers too!"
