Same as if you are selling your house. You have a listed price. Are you going to sell to the guy that made a full price offer or one that comes in with a higher than full price offer. As long as you have not signed anything you can and most likely will take the higher offer.
 
So yes I know charity auctions.
And yes I know mods read PM's
However, I doubt it was a for sale by auction listing like the charity auctions are.
Mods read PM's for actual reasons.
 
Until an exact time place and conditions of sale are agreed upon by both buyer and seller the seller can do anything he likes with the item.
I have this directly from a mod when giving a welcher a negative feedback.

I have had sellers back out several times, just move on and remember not to deal with them again. Another deal will come along
 
The latter may be true.
The reason it is relevant is that even if he did have a deal, there is no obligation to sell at the meet.
There is certainly no obligation to sell without a confirmed deal.
How are the mods supposed to moderate what happens in PM!

Life should be fair.

Well....considering the mods (Certain ones) read pms without consent or cause....
